LEGALITY

1. Service Disruptions

You may face Service disruptions, including, but not limited to disconnection or communication interferences due to issues in the internet infrastructure used for providing or accessing the Services or due to issues with the hardware and software used by you. You understand that BERSERK SKILLS CREATIVE WORK PVT LTD has no control over these factors. BERSERK SKILLS CREATIVE WORK PVT LTD shall not be responsible for any interruption in Services and you take full responsibility for any risk of loss due to Service interruptions for any such reason.

If you are unable to play any Game due to any error or omission directly attributable to BERSERK SKILLS CREATIVE WORK PVT LTD, the settlement will be as per the "Game Cancellation" Settlement Policy and the entry fee would be refunded accordingly. The company attempts to start games immediately once the minimum number of players join, but no guarantee is made, and delays may occur for any reason.

2. Promotions

Bring A Friend ("BAF"): You can invite others to use the Services by accessing the "Bring-A-Friend" feature. Bonus plans are governed by applicable terms and conditions. Games offered under Promotions may be canceled or discontinued without prior notice, except refund of entry fees, if applicable.

3. License Agreement & Intellectual Property

All content provided is owned by BERSERK SKILLS CREATIVE WORK PVT LTD or its licensors. Users are granted a non-exclusive license for personal use only. Copying, reproducing, distributing, modifying, or creating derivative works without written permission is strictly prohibited.

4. User Account Suspension

• Suspected violation of Terms,

• Suspected breach of security,

• Charge-backs on the user account.

The decision to suspend or restrict service shall be final.

5. Breach and Consequences

In case of breach of Terms, BERSERK SKILLS CREATIVE WORK PVT LTD may:

• Restrict games,

• Suspend accounts,

• Demand damages,

• Initiate legal actions,

• Bar future registrations.

6. Modifications and Alterations

Terms may be changed without prior notice. Continuing to use the Services implies acceptance of the modified Terms.

7. Limitation of Liability

BERSERK SKILLS CREATIVE WORK PVT LTD shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of access to or use of Services. Users agree to indemnify BERSERK SKILLS CREATIVE WORK PVT LTD and its service providers.

8. Governing Law, Dispute Resolution & Jurisdiction

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai.

9. Age Restrictions

You must be 18 years or older to access Services. Players from Assam, Telangana, Tamil Nadu, Odisha, West Bengal, Sikkim, Nagaland, Andhra Pradesh, and Meghalaya are not permitted to play.

10. Game Services

All tournaments, promotional games, practice games, and online games organized are collectively referred to as "Games." Service charges are inclusive of applicable taxes.
